Welcome to Nurse Alarm™ (the “App”), operated by Nurse Alarm LLC (“Company,” “we,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms of Service (the "Terms"). Please read them carefully.
The App is designed to assist with personal alarms and reminders only. It is intended as a supplemental tool to help users wake up, keep appointments, or support shift schedules. Users are solely responsible for their professional duties and schedule, including but not limited to, waking up, attending appointments, or completing tasks.
The App should not be relied upon for emergency alerts or life-critical situations and is not a medical device, emergency system, or primary alarm system, and it does not provide medical services such as: medical advice, diagnosis, or treatment.
Alarm functionality may be affected by device settings, battery levels, operating system behavior, network conditions, or other factors outside our control. We do not guarantee that alarms or notifications will trigger, fire, or be received at any specific time.
You acknowledge that mobile operating systems (e.g., iOS/Android) may restrict or terminate background processes to optimize battery life or performance. This may prevent alarms from firing or future alarms from being scheduled in the background. Furthermore, manually closing (or force-quitting) the App or restarting your device may suspend the App's background scheduling capabilities. It is your responsibility to ensure the App is excluded from Battery Optimization or Low Power Mode, and to periodically open the App to ensure background tasks successfully refresh your future schedule.
Additionally, core features of the App, including background alarm refreshing and future scheduling, require specific device permissions (e.g., Alarms & Reminders, Notifications, Background App Refresh). If you choose to deny or revoke these permissions, the App will not function as intended, and the Company is not liable for any resulting failure of the App to schedule or trigger alarms.
You are responsible for verifying alarms and reminders. The App is provided to support your schedule, but users are solely responsible for their schedule, including but not limited to, waking up, attending appointments, or completing tasks.
Eligibility: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use this App. By using the App, you represent that you meet this requirement.
We respect your privacy. The App is designed to store data locally on your device. You may optionally choose to use personal cloud storage services (such as Apple iCloud or Google Drive) for backups.
Your use of these third-party services is governed solely by the terms and conditions of those respective providers. You acknowledge and agree that Nurse Alarm LLC is not responsible for the security, availability, or integrity of data stored in third-party environments, and we are not liable for any data loss, corruption, or breaches occurring within those services.
You may optionally share feedback or diagnostic logs with us. For more information, please see our Privacy Policy at nursealarm.app/privacy.
All content in the App, including code, graphics, and icons, is owned by the Company or properly licensed. You may not copy, reproduce, modify, or distribute any part of the App without explicit written permission.
6.1 In-App Purchases and Refunds: In-App purchases will be charged to your App Store or Google Play account. All refund requests must be directed to Apple or Google, as we do not have the authority to process refunds directly.
6.2 Restore Purchases: You are responsible for using the "Restore Purchase" function within the App if you change devices or reinstall the App. This function requires you to be signed into the same Apple ID or Google Account used for the original purchase.
6.3 Advertisements: The App may display advertisements provided by third-party ad networks (such as Google AdMob). We do not control, endorse, or guarantee the products, services, or content of these third-party advertisements. Your interaction with any advertiser is solely between you and that third party.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.
Upon termination or your decision to stop using the App, you may delete your local data by uninstalling the App and manually clearing any associated cloud backups.
To the maximum extent permitted by law:
We are not liable for any damages, losses, or claims arising from the use or inability to use the App, including but not limited to personal injury, missed appointments, lost income, or other consequential damages.
We are not liable for failures or delays caused by events beyond our reasonable control, including but not limited to telecommunications failures, power outages, natural disasters, or government actions.
Our total liability is limited to the amount you paid for the App (if any) in the 12 months prior to the claim, or $1 if the App was free.
The App is provided “as is,” without warranty of any kind, express or implied, including fitness for a particular purpose or non-infringement.
Any disputes arising from or related to this App will be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association (AAA). You and the Company agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Travis County, Texas.
These Terms constitute the entire agreement between you and Nurse Alarm LLC regarding the App and supersede any prior agreements.
We may update these Terms from time to time. Updated terms will be effective immediately upon posting in the App or on our website. Continued use of the App constitutes acceptance of changes.

13.1 Acknowledgement: You and Nurse Alarm LLC acknowledge that these Terms are concluded between you and Nurse Alarm LLC only, and not with Apple, Inc. (“Apple”). Nurse Alarm LLC, not Apple, is solely responsible for the App and the content thereof.
13.2 Maintenance and Support: Nurse Alarm LLC is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
13.3 Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
13.4 Product Claims: You acknowledge that Nurse Alarm LLC, not Apple, is responsible for addressing any claims related to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
13.5 Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Nurse Alarm LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
13.6 Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
13.7 Third-Party Beneficiary: You and Nurse Alarm LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
14.1 Acknowledgement: You acknowledge that these Terms are a contract between you and Nurse Alarm LLC only, and not with Google LLC or any of its affiliates (“Google”).
14.2 Google as Third-Party Beneficiary: You acknowledge that Google is a third-party beneficiary of these Terms. Upon your acceptance of these Terms, Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14.3 Precedence: In the event of any conflict between these Terms and the Google Play Developer Distribution Agreement, the Google Play Developer Distribution Agreement shall take precedence.
